Request for New Trial in Laken Riley Murder Case

Jose Ibarra, convicted for the murder of nursing student Laken Riley, has filed a motion for a new trial, citing legal errors.

Judge H. Patrick Haggard of Athens-Clarke County Superior Court found Jose Ibarra guilty of murder and additional charges related to the death of Laken Riley in February. Ibarra had waived his right to a jury trial, allowing the judge to render the verdict. Recently, Ibarra’s legal team requested a retrial, arguing that the verdict was ‘contrary to law’ and ‘contrary to the evidence.’ They further contended that the court committed errors that necessitate reconsideration of the case. Although the attorneys did not elaborate on the specifics, they indicated that they might supplement their motion following a thorough review of the trial’s details.

The case has been a focal point in the ongoing discussion about immigration, especially during the current presidential campaign. According to federal immigration authorities, Ibarra, a Venezuelan national, entered the United States illegally in 2022 and was permitted to stay while pursuing his immigration case. Prosecutors allege that Ibarra encountered Riley, then a 22-year-old student from Augusta University College of Nursing, as she was jogging on the University of Georgia campus and killed her in a subsequent struggle. Riley studied at Augusta University, which has a campus in Athens, located about 70 miles east of Atlanta.

Judge Haggard, on November 20, found Ibarra guilty of all ten charges and sentenced him to life imprisonment without parole — the maximum punishment allowed. Under Georgia law, filing a motion for a new trial extends the deadline for appealing the case. Convicts must typically file an appeal within 30 days of a final conviction, which is marked either by the sentencing or rejection of a motion for a new trial.
