Blake Lively Moves to Dismiss Justin Baldoni’s Defamation Lawsuit, Citing California’s Protection for Sexual Harassment Accusers

Blake Lively is seeking to have a $400 million lawsuit filed by Justin Baldoni against her dismissed. Lively argues that Baldoni, her “It Ends With Us” co-star, is using a defamation claim as a tool to retaliate against her for publicly addressing her sexual harassment accusations against him. This legal motion, submitted on Thursday, follows a similar motion filed by her husband, Ryan Reynolds, two days prior, aiming to have his name removed from the case as well.

Baldoni, alongside his business partners and production company, Wayfarer Studios, has targeted Lively, Reynolds, and their publicist with the lawsuit. They allege the couple hijacked Baldoni’s film and sought to damage his career. Leslie Sloane, the couple’s publicist, has also submitted a motion to dismiss the charges.

Lively’s legal team contends she is protected under California law, which bars retaliatory defamation lawsuits stemming from sexual harassment claims. This legislation was enacted by Governor Gavin Newsom in October 2023. Baldoni has accused Lively of attempting to ruin him professionally by collaborating with the New York Times on a story about her complaint with the California Civil Rights Department, alleging sexual harassment and retaliation.

Lively’s attorneys maintain that she had every right to file her complaint and share it with the public, including the media. The New York Times has defended its reporting and has requested the dismissal of Baldoni’s $250 million lawsuit against it. Lively’s legal team argues that Baldoni’s lawsuit lacks legal merit and serves as a public relations strategy to punish her for speaking out.

The attorneys further assert that Baldoni’s complaint relies on conjecture and conspiracy theories rather than factual evidence. They note a contradiction in Baldoni’s claims: while portraying Lively as a powerful Hollywood figure capable of commandeering his film, they also allege she was powerless, fabricating harassment claims as part of a long-term strategy.

Lively is also seeking legal fees and punitive damages. Ryan Reynolds, in his motion to be removed from the lawsuit, argues that his involvement is limited to his role as a supportive spouse, with Baldoni’s complaint amounting to little more than “hurt feelings.” Reynolds’ filing contends that his comments about Baldoni being a “predator” are constitutionally protected opinions.

Lively has recently amended her complaint to include allegations from other women regarding Baldoni’s conduct on set, claims which Baldoni continues to deny.
