Charges have been dropped against two men from Rhode Island in the case involving the death of a fan after a dispute at a 2023 New England Patriots game. Justin Mitchell and John Vieira, who had been facing misdemeanor charges for assault and battery, as well as disorderly conduct, were accused of having struck Dale Mooney, 53, from Newmarket, New Hampshire.
The charges were dismissed on Friday “in the interest of justice,” according to a court filing by Norfolk District Attorney Michael Morrissey. No additional details were provided regarding the decision.
Investigations revealed that Mooney was hit during an incident at the game held at Gillette Stadium, which concluded with the Miami Dolphins defeating the Patriots 24-17. Mooney was transported to a hospital where he was later declared deceased. Video footage from the stadium indicated that Vieira was attempting to assist another individual in self-defense during the unprovoked confrontation, as stated by Vieira’s attorney, Peter Aspesi.
A request for comment was sent to Mitchell’s attorney, Daniel Gelb, on Tuesday. The Office of the Chief Medical Examiner initially suggested that there were no traumatic injuries but highlighted a medical issue with Mooney. The final autopsy ruled the death a homicide, with the probable cause being cardiac dysrhythmia in an individual with severe cardiovascular conditions during the physical altercation.
After reviewing the available evidence, including the autopsy findings and various video angles, it was determined that there was no basis for continuing criminal prosecution for homicide-related charges.
