A former Miami Beach police officer will not serve jail time following a conviction related to an incident involving the beating of a tourist four years ago. On Thursday, Kevin Perez, one of the officers involved in the altercation at a local hotel, received his sentence in the Miami-Dade Circuit Court.
Judge Alberto Milian decided to withhold adjudication, granting Perez six months of probation. This decision allows Perez to avoid a formal conviction and imprisonment. The judge expressed his view that jail time was not warranted in this case.
In 2021, Perez was found guilty of misdemeanor simple battery during the forceful arrest of Dalonta Crudup. The incident, captured on video, showed Perez and several other officers striking Crudup, who is now 28 years old. Initially charged with felony battery, the jury was limited to considering the lesser charge of simple battery after the court ruled that the prosecution failed to prove the elements necessary for a felony conviction.
The prosecution, alongside Crudup’s mother, advocated for a prison sentence for Perez. Crudup’s mother, speaking on behalf of her son who is currently incarcerated in another state, urged the court to hold Perez accountable to prevent similar conduct in the future.
A request for a new trial by Perez’s defense was initially approved but later overturned by the Third District Court of Appeals. During the sentencing, Perez received support from family members and fellow officers, including Sgt. Ricardo Castillo, who credited Perez with saving his life during a duty-related incident.
Judge Milian did not require Perez to make a statement in court and concluded the session by addressing Crudup’s mother. He acknowledged her concerns and love for her son, while noting that Crudup has opportunities for a brighter future if he adheres to the law.
