Men Cleared of Charges in Fatal Patriots Game Altercation

Norfolk County prosecutors have dropped charges against two men who were initially accused of involvement in a physical altercation during a 2023 New England Patriots game. The incident, which occurred in September at Gillette Stadium, resulted in the tragic death of a 53-year-old man, Dale Mooney, from New Hampshire.

John Vieira, aged 59, and Justin Mitchell, aged 39, both residents of Warwick, Rhode Island, faced charges of assault and battery and disorderly conduct. However, during a recent motion hearing at Wrentham District Court, these charges were dismissed, as indicated by court records.

The altercation unfolded in the 300s tier of the stadium during a game between the Patriots and the Dolphins. Following the incident, Mooney required immediate medical attention and was subsequently transported to Sturdy Memorial Hospital in Attleboro, where he was declared deceased.

Although Mooney’s death was ruled a homicide, the office of Norfolk District Attorney Michael Morrissey decided not to pursue homicide charges against Vieira and Mitchell. An initial autopsy did not reveal a traumatic injury as the cause of death, and no specific medical issue was identified.

A comprehensive review of the evidence, including autopsy results and multiple video angles, led to the conclusion that homicide charges were not supported in this case. Spectators at the scene described a heated exchange between sections of the crowd, culminating in a confrontation involving Mooney.

One eyewitness recounted seeing a Dolphins fan strike Mooney in the face, leading to Mooney being knocked unconscious. Emergency medical personnel arrived to administer CPR, but Mooney did not recover. The incident has been described as unfortunate, with sympathies extended to Mooney’s family.
