Elliott has agreed to a plea arrangement involving a maximum prison term of 10 years and the suspension of his driver’s license. The suspension will last for at least three years, with the possibility of being extended for life. Additionally, Elliott is set to face up to five years of parole and fines that could total as much as $30,000. His sentencing is scheduled for May 29.
In earlier developments, charges of aggravated vehicular homicide and operating a vehicle under the influence were dismissed in the legal proceedings. The incident in question occurred at approximately 11:15 p.m. on August 25, 2023, when Elliott was driving a 1999 Lexus LS southbound on Ohio 741. As he approached the intersection at Lyons Road, he failed to stop at a red light, resulting in a collision with a 2010 Nissan Versa. The Versa was turning from Ohio 741 onto Lyons Road at the time of the crash.
The impact forced the Nissan to collide with a traffic pole before it came to a halt in the southbound lanes of Ohio 741. Meanwhile, Elliott’s vehicle continued moving, striking a curb, an AT&T box, and eventually coming to rest in a ditch. Denis Benjamin Jacob, a 40-year-old resident of Miami Township and the driver of the Nissan, was pronounced deceased at the scene. Emergency responders transported Elliott to Kettering Health Dayton for potential injuries. Subsequent blood tests indicated the presence of cannabinoids and opioids in his system.
