Texas House Approves Bill Expanding School Disciplinary Powers

The Texas House has taken significant steps towards amending disciplinary measures in schools with the initial approval of a bill that seeks to broaden the criteria for suspending students, particularly targeting homeless and younger students. The proposal, which saw revisions to address concerns about its broad application, allows schools to enforce out-of-school suspensions for students causing “repeated and significant” disruptions or posing threats to the safety of others.

House Bill 6, if enacted, would amend existing laws from 2017 and 2019, thereby extending suspension possibilities to include homeless students and children from pre-K through second grade. This legislative move has garnered substantial support from House Republicans, who have co-authored the bill to signal their backing.

During the session, legislators introduced a late amendment regarding the use of disciplinary alternative education programs, which serve as alternatives to suspension or expulsion. Under the new measures, students involved in physically attacking teachers or making serious threats would be required to attend these programs for a minimum of 30 days. Additionally, the bill seeks to abolish a law mandating that students caught vaping be transferred to alternative education environments.

Another notable provision allows schools to conduct remote teaching within alternative education programs, despite concerns about learning loss associated with remote instruction highlighted during the COVID-19 pandemic. The current bill reflects adjustments made after extensive feedback during a public education committee hearing, including the involvement of knowledgeable professionals in intervention decisions for students with disabilities.

Authored by Rep. Jeff Leach, the bill mandates that educators exhaust classroom management techniques and substantiate the threat level before removing students. This initiative addresses the surge in classroom violence post-pandemic, which has strained teachers and contributed to high turnover rates statewide. Attempts by some Democrats to incorporate amendments for additional student resources, such as psychological services, were unsuccessful. Leach emphasized the necessity of consequences for maintaining order and ensuring a conducive learning environment.

In the discourse, certain Democrats, including Dallas Rep. John Bryant, suggested reserving discussions about resource allocation for the forthcoming school finance bill deliberations. As the legislative process continues, broader educational policies and resources remain a topic for future sessions.

The Broader Impact

The proposed legislative changes could significantly affect students, educators, and the broader educational community in Texas. By expanding the criteria for student suspensions, schools may experience a shift in how they handle disciplinary issues, potentially leading to a more controlled classroom environment. However, this move might also raise concerns about the marginalization of vulnerable student groups, particularly homeless and younger children.

For educators, the bill provides a framework to address disruptive behavior more decisively, potentially reducing instances of classroom violence and improving job satisfaction. Nevertheless, it also places the onus on teachers to demonstrate comprehensive classroom management efforts before resorting to suspension, which could add to their responsibilities. The introduction of remote learning in alternative settings may offer flexibility but also risks repeating the challenges of the pandemic-era education system.

As communities and policymakers navigate these changes, the emphasis on balancing disciplinary measures with supportive resources remains crucial. Ensuring that students receive both consequences and necessary support will be key to fostering a positive educational environment and addressing the complexities of student behavior in a post-pandemic world.
