As jury selection continued for the second day in Harvey Weinstein’s #MeToo rape retrial, his legal team requested that the former studio executive be allowed to spend nights at a New York City hospital instead of Rikers Island jail. Citing concerns over Weinstein’s health, the lawyers argued that his current detention conditions are exacerbating his medical issues, suggesting he would be better housed in the prison ward at Bellevue Hospital.
The 73-year-old Weinstein, who has appeared in court in a wheelchair, suffers from a range of health problems, including chronic myeloid leukemia, heart issues, diabetes, obstructive sleep apnea, sciatica, and serious mobility limitations. His legal team also highlighted a recent misdiagnosed tongue infection at Rikers that necessitated hospitalization and noted a significant weight gain in the past month.
Weinstein’s lawyer, Imran Ansari, stated that the detention facility’s harsh conditions, including cold temperatures and inadequate clothing, have further deteriorated his health. The legal team previously filed a $5 million claim against New York City, alleging substandard medical care at Rikers and repeated premature transfers back to jail from the hospital.
Rikers Island jail complex has come under increased scrutiny for its treatment of detainees and unsafe conditions, with a federal judge last year allowing the possibility of federal oversight due to the city’s failure to ensure inmate safety.
Judge Curtis Farber has yet to decide on the hospital transfer request, and the topic remained undiscussed as jury selection continued. The previous day ended without juror selection, with Wednesday seeing two dozen potential jurors summoned for further questioning.
Weinstein faces retrial following the New York Court of Appeals’ decision to overturn his 2020 conviction and 23-year sentence, citing flawed rulings and prejudicial testimonies in the original trial. The charges involve allegations of rape in a 2013 Manhattan hotel incident and a 2006 criminal sex act, along with a new charge based on a different woman’s accusation. Weinstein maintains his plea of not guilty to all charges.
