Chinese Automaker BYD Responds to Labor Allegations in Brazil

In recent developments, Chinese automaker BYD has faced critical reports regarding the labor conditions at its factory construction site in Brazil, where allegations of “slavery-like” environment have surfaced.

A task force composed of Brazilian prosecutors reported rescuing 163 Chinese nationals from conditions that they described as akin to slavery. The Labor Prosecutor’s Office shared video evidence of workers accommodated in inadequate dormitories, highlighting the absence of basic amenities like mattresses and proper cooking facilities. This revelation has prompted widespread attention and scrutiny.

BYD has strongly countered these claims through a statement by spokesperson Li Yunfei, issued on a social media platform. Li accused external entities of fabricating these reports as part of a broader agenda to tarnish Chinese brands and strain diplomatic ties between China and Brazil. In response to the allegations, BYD announced the termination of their contract with Jinjiang Group, the firm overseeing the construction, and is deliberating additional steps to address the situation. The automaker assured that the Jinjiang employees would temporarily stay in local hotels, ensuring their well-being until further notice.

The accusations extend beyond living conditions, highlighting claims that Jinjiang Construction Brazil withheld significant portions of the workers’ wages and confiscated passports, demanding hefty repayments for travel expenses from those who chose to quit. This condition, characterized as forced labor, contravenes Brazilian labor laws which define such abuse as slavery-like due to enforced labor, restricted worker freedom, and degrading conditions.

Jinjiang Construction Brazil, while under intense inspection by local labor authorities, has dismissed these allegations, attributing them to cultural misunderstandings and language barriers leading to misinformation. The company stressed its compliance with labor inspections and asserted the workers’ willingness to clarify these misconceptions through direct dialogue with media.

Meanwhile, a video circulated on social media depicted workers at the site testifying against the claims. In this footage, one worker read a statement asserting a violation of their human rights due to the mischaracterization of their conditions, which they argue was a misunderstanding. The workers showed support by applauding the statement, emphasizing their desire to continue their employment at the site.

The broader issue of migrant labor in developing regions brings to light the commonality of subpar living conditions and contracts requiring workers to repay recruitment fees, contrary to legal frameworks designed to protect laborers.

The situation at BYD’s Brazilian site underscores the complexities involved in international labor practices and the challenges in navigating cultural and legal disparities.
