Los Angeles DA Reviews Menendez Brothers’ Case Amid New Developments

In a significant move for the Menendez brothers’ prolonged legal battle, the newly appointed Los Angeles County District Attorney has engaged with their family as part of an ongoing case review. This development comes 35 years post their conviction for the murders of their parents, Jose and Kitty Menendez.

The meeting took place on Friday and lasted about three hours. During this session, Nathan Hochman, who assumed office in December, described the interaction with the family as ‘productive.’ The family members articulated their perspectives on why Erik and Lyle Menendez, now in their 50s, should be considered for release.

The Menendez brothers were convicted in 1989, sentenced to life in prison without the possibility of parole. Their case gained renewed attention when claims of sexual abuse by their father resurfaced. In light of this, the brothers’ legal team submitted a habeas corpus petition in May 2023, proposing the court reassess the evidence concerning their detention’s legality.

A majority of the Menendez extended family supports the brothers’ release, arguing that today’s understanding of sexual abuse could have influenced their initial conviction, potentially avoiding a first-degree murder sentence. In October 2024, the previous District Attorney, George Gascon, suggested a re-sentencing to 50 years to life, making them eligible for parole. Hochman criticized this as politically motivated, suggesting it compromised the decision’s impartiality.

Hochman is reviewing extensive prison documentation to evaluate the brothers’ rehabilitation efforts. Evidence might include behavior in prison, contributions to inmate programs, or self-improvement initiatives.

The case’s re-sentencing hearing was postponed from early December to late January, providing Judge Michael Jesic and Hochman additional time to examine the evidence thoroughly.

Originally, the defense for the brothers claimed abuse at the hands of their father, a point the prosecution denied, arguing that the motive was financial gain. Post-conviction, numerous appeal attempts have been unsuccessful.

Currently, Erik and Lyle Menendez are held at Richard J. Donovan Correctional Facility in San Diego.
