The Middlesex County District Attorney’s Office announced on Tuesday that an Everett police officer was justified in the use of deadly force against a suspect who attempted to hijack a commercial refuse truck near the Encore Boston Harbor casino last summer.
According to the official findings released by the District Attorney, Officer Daniel Wall shot 33-year-old Admilson Vizcaino on July 31, 2025, as the suspect attempted to commandeer a Republic Services truck while the driver was still inside. Prosecutors concluded that Officer Wall will not face criminal charges in connection with the incident.
The chain of events reportedly began in Medford around 12:45 p.m., where police received reports of Vizcaino acting erratically. Following a pursuit that crossed municipal lines into Everett, officials state that Vizcaino crashed his SUV into multiple vehicles on Broadway. District Attorney Marian Ryan noted in the report that despite being deployed with a Taser and surrounded by law enforcement, the suspect remained non-compliant and brandished a knife.
Investigators determined that as Vizcaino forced open the driver’s side door of the stopped trash truck, Officer Wall fired his weapon. The District Attorney’s office stated in a press release that Wall’s actions were based on a “reasonably objective belief” that the truck driver, the officer himself, and nearby citizens were in “imminent danger of death or serious bodily injury.”
Despite sustaining gunshot wounds, authorities report that Vizcaino managed to gain control of the heavy vehicle and drove it for approximately half a mile. The truck struck utility poles and caused significant property damage before Massachusetts State Troopers deployed “stop sticks” to deflate the tires on the Alford Street Bridge, ending the pursuit.
Vizcaino, who survived the encounter and was arraigned in his hospital bed days after the event, faces numerous charges. These include five counts of attempted armed carjacking, two counts of armed carjacking, and assault by means of a dangerous weapon.
Legal Findings and Judicial Proceedings
The conclusion of this internal review formally clears Officer Wall of criminal liability, closing the investigation into the specific use of force during the 2025 confrontation. The focus of the case now shifts entirely to the prosecution of Vizcaino, who faces a complex array of felony charges related to the multi-jurisdictional pursuit and the alleged armed robbery attempt. It is important to note that all individuals are presumed innocent until proven guilty in a court of law.
