Customers who bought Deep River Snacks marked with a ‘Non-GMO Ingredients’ label in recent years might be eligible for compensation due to a recent class action settlement.
Old Lyme Gourmet Co., the company responsible for Deep River Snacks, is at the center of a class action lawsuit. Customers allege that the company misled them by labeling certain products with a ‘Non-GMO Ingredients’ graphic, implying third-party certification which was not the case. This lawsuit, known as Rankins v. Old Lyme, claims that consumers were given the impression that the snacks were certified by entities like the Non-GMO Project, assuring them of the absence of genetically modified ingredients. Despite these allegations, Old Lyme Gourmet Co. denies any wrongdoing, and the matter remains unresolved in court.
The settlement terms apply to anyone in the United States who purchased Deep River chips with the disputed label between February 2, 2017, and December 6, 2024. Affected consumers can potentially receive monetary compensation by filing a claim. The deadline for submitting claims is July 28, 2025. Claims can be filed online by visiting the class action’s website and starting the claim process, or by downloading a PDF claim form, completing it, and mailing it in.
For claims that include proof of purchase, individuals will receive $5.00 for the first product and $0.50 for each additional product, with no cap on the number of products if each has proof of purchase. In cases without proof of purchase, compensation is limited to $5.00 for the first product and $0.50 for each of up to ten additional products. Only one claim per household is permitted. It’s important to submit claims before the deadline to ensure eligibility for any settlement benefits.
