In a significant legal decision, the Inter-American Court of Human Rights has found the Venezuelan government guilty of violating the political rights of former opposition candidate Henrique Capriles during the contentious 2013 presidential election.
The court’s ruling, issued from San Jose, Costa Rica, highlights the misuse of state resources to support the candidacy of President Nicolás Maduro, which undermined the fairness of the election process. The court noted that these actions compromised Henrique Capriles’s political rights, including his freedom of expression and right to equal treatment under the law.
Capriles, a charismatic lawyer from an upper-middle-class background, was seen as a formidable opponent to the late President Hugo Chávez in the 2012 elections. He later lost the 2013 elections to Maduro in a closely contested race, marred by allegations of irregularities.
Despite the court’s directive in 2017 to lift the political ban against Capriles, the Venezuelan government has ignored these orders. Instead, the Supreme Justice Tribunal extended his disqualification from political engagement until 2032. In July, Maduro’s administration declared victory in an election that was allegedly fraught with irregularities, as reported by the opposition. Although the opposition’s tally sheets indicated a win for their candidate, Edmundo González, the National Electoral Council—comprised mainly of Maduro supporters—announced Maduro as the winner shortly after polls closed.
