Eviction Notice Issued for Restaurant at Apache Mall

A recent court settlement has resulted in the eviction of Charleys Philly Steaks from Apache Mall in Rochester due to unpaid rent and fees. As part of the agreement filed this week in Olmsted County District Court, the restaurant must vacate the premises by 11:59 p.m. on May 5, 2025. The agreement also mandates the handover of all keys to the mall by Charleys’ management.

The ownership of Apache Mall, headquartered in Delaware, initiated the eviction process with an 86-page complaint filed on March 7. This complaint accused Charleys of owing over $153,000 in unpaid rent and associated fees. The restaurant’s lease obligated it to pay a monthly rent of $6,510.25, amounting to over $78,000 annually, alongside other fees.

Additionally, the complaint referenced a letter sent to Charleys in October, which indicated arrears of more than $130,000 at that time. Charleys Philly Steaks has occupied its location in Apache Mall since 2016.
